This website is owned and operated by Living Legacies LLC, a South Dakota limited liability company (“Living Legacies”). By accessing or using this website and the services offered, you agree to these Terms and Conditions. If you do not agree, do not use the website or purchase services.

You must be at least 14 years old (or of legal majority in your jurisdiction) to use this website or purchase services. Use of the website or purchase of services may be prohibited in certain jurisdictions; you are responsible for compliance with all applicable laws.

Commercial Terms

By purchasing a product or service through the website, you (“Beneficiary”) enter into a legally binding agreement and agree to these Terms.

• Prices for products and services are listed on the website and may be updated without prior notice.

• Sales tax is applied based on the planting location; currently, South Dakota sales tax of 4.2% applies.

• Online payment includes a 3% processing fee reflected at checkout.

Return and Refund Policy

All purchases are final. Refunds are only issued in the event of errors caused by Living Legacies or the website. Claims must be made within 30 days of purchase.

Trees are part of collective groves planted seasonally. While we partner with experienced landowners to maximize survival, Living Legacies cannot guarantee the life of any individual tree. There is no warranty beyond replanting trees damaged within three (3) years due to infestation, storm, disease, drought, or fire.

No Visit Rights

Trees are planted in local community groves and are not individually tagged or visitable. Families and Beneficiaries do not have the right to access planting sites. Living Legacies is not responsible for any individual accessing grove locations.

No Ownership Rights Conveyed

Purchasing a tree does not grant any ownership, lease, or other legal interest in any land or tree. Your purchase is a contribution toward a local conservation initiative and memorial program.

Planting Location Disclaimer

Living Legacies LLC strives to plant trees in the location requested whenever possible. If a local landowner or partner cannot be found in the desired county, the tree will be planted elsewhere in the state at the discretion of Living Legacies LLC. If no suitable location is identified, Living Legacies reserves the right to plant the tree at an alternative location of our choosing. Purchasers acknowledge that the exact location of individual trees may not be guaranteed, and Living Legacies is not liable for planting outside the originally requested location.

Intellectual Property

All website content and branding remain the property of Living Legacies. By submitting content to the website, you confirm that you have the right to share it and consent to public display if applicable.

Limitation of Liability

To the maximum extent permitted by law, Living Legacies is not liable for indirect, incidental, punitive, or consequential damages, including lost profits or personal injury.

Beneficiary’s sole remedy in any dispute or claim is a refund of the purchase price paid to Living Legacies.

Indemnification

You agree to indemnify and hold Living Legacies harmless from any claims, liabilities, losses, or expenses arising from your use of the website or services.

Changes to Services and Terms

Living Legacies reserves the right to change services, pricing, or Terms at any time without prior notice. Your continued use of the website constitutes acceptance of the updated Terms.

Promotional Communications

You may receive promotional messages by email, phone, or text. You may opt out at any time; opting out does not affect your purchase but may limit optional updates on groves or collective acknowledgments.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of South Dakota. Any legal action must be filed in Yankton County, South Dakota.
